  • Please read carefully At Reekolect, we highly value the privacy of our visitors and users. This Privacy Policy ("Privacy Policy") outlines how Reekolect, including its affiliated companies worldwide ("Reekolect," "we," "our," or "us"), collects, uses, and shares your Personal Information. Additionally, we explain the data rights you may have concerning this Personal Information. This Privacy Policy applies to all Reekolect users, encompassing unregistered visitors, registered users, and premium users (collectively referred to as "Users," "you," or "your"). Furthermore, this policy pertains to all Reekolect services, which include our websites (including www.reekolect.com and any subdomains, hereinafter the "Website"), web applications ("Reekolect Apps"), mobile applications ("Mobile Apps"), and associated services (together referred to as the "Services"). It's important to note that this Privacy Policy does not override the terms of any contract you may have with us or any rights you may possess under other applicable data privacy laws. User information: In order to provide you with our Services, we must collect Personal Information concerning an identified or identifiable natural person ("Personal Information").   • Why do we collect such 'Personal Information' We utilize your Personal Information for the following purposes:

Machine learning may also be utilized to help us monitor, identify, and suspend accounts involved in spam or other abusive or fraudulent activities.

We use your Personal Information for the purposes described in Section 3 when:

Additionally, we collect and use Personal Information to contact Users and to adhere to applicable laws.

 

  • How we share your ‘Personal Information’ We may share your Personal Information as described below:

4.1. Third Party Service Providers: Reekolect has partnered with various selected service providers, offering services that complement and enhance our own. These service providers include hosting and server co-location services, communications and content delivery networks (CDNs), data and cybersecurity services, billing and payment processing services, domain name registrars, fraud detection and prevention services, web analytics, email distribution and monitoring services, session recording and remote access services, performance measurement, data optimization and marketing services, content providers, and our legal and financial advisors (collectively referred to as "Third Party Service Provider(s)").

Reekolect may share the following categories of Personal Information with Third Party Service Providers:

  • Identifiers: This includes information like name, alias, postal address, unique personal identifier, online identifier, internet protocol (IP) address, email address, account name, or similar identifiers.

  • Commercial Personal Information: This category comprises Personal Information related to products or services purchased, obtained, or considered.

The sharing of Personal Information with Third Party Service Providers is subject to this Privacy Policy.

4.2. Law Enforcement, Legal Requests, and Duties: Reekolect may disclose or provide access to your Personal Information, including the categories mentioned in this Privacy Policy, in response to legal requests such as subpoenas, court orders, search warrants, or legal proceedings. This disclosure may also occur to comply with applicable laws, with or without prior notice to you.

4.3. Protecting Rights and Safety: We may share Personal Information categories detailed in this Privacy Policy if we have a good faith belief that it will help protect the rights, property, or personal safety of Reekolect, our Users, Users-of-Users, or the general public, with or without notice to you.

4.4. Reekolect Subsidiaries and Affiliated Companies: Internally within our family of companies, we may share your Personal Information for the purposes outlined in this Privacy Policy. For example, we may share your Personal Information with Wix.com Inc., our US-based subsidiary, to facilitate and provide you (and your Users-of-Users) with our Services. Sharing Personal Information by Reekolect subsidiaries and affiliated companies within the European Union, the United Kingdom, and Switzerland with Reekolect's subsidiaries located outside these regions will occur under approved transfer mechanisms such as relevant Standard Contractual Clauses.

4.5. In Connection with a Change in Corporate Control: In the event of a change in corporate control, such as a merger, acquisition, or purchase of substantially all of our assets, your Personal Information may be shared with the involved parties.

4.6. Upon Your Further Direction: Reekolect's Services enable you to engage and procure various third-party services, products, and tools for enhancing your web or mobile sites. These include applications and widgets offered by third parties through the Reekolect Website (including the Reekolect App Market), eCommerce payment providers, third-party designers who may assist you with your website, and more (collectively referred to as "Third Party Services"). If you choose to engage with these Third Party Services, they may have access to and process Personal Information of Users-of-Users collected through your web or mobile sites. For example:

a) Framed Pages: Our Services allow you to integrate Third Party Services directly into your web or mobile sites using techniques like page framing to serve content to or from Third Party Services. In such cases, Third Party Services may collect Personal Information from your Users-of-Users.

b) App Market Developers: We permit third-party developers ("Third Party Developer(s)") to create and offer their applications through the Reekolect App Market ("Third Party App(s)") for Users to integrate into their web or mobile sites. Each Third Party Developer adheres to the Wix App Market Partner Agreement, which imposes restrictions on how these developers may access, store, share, and use Personal Information provided by you and/or your Users-of-Users.

c) Social Media Features: Our Services enable you to integrate certain Social Media features, widgets, and single sign-on features, such as "Facebook Connect" or "Google Sign-in" ("Social Media Features") into your web or mobile sites. These Social Media Features may collect specific Personal Information from Users-of-Users.

In these examples, Reekolect serves as an intermediary platform, allowing you to procure the services of Third Party Services directly. Reekolect acts as a service provider to you, disclosing information to Third Party Services on your behalf. Reekolect is not responsible for Third Party Services' processing of such Personal Information or liable in connection therewith. Please note that Reekolect does not control or assume responsibility for the actions or policies of any Third Party Service, and your use of any Third Party Service is at your own risk. We encourage you to review the privacy policy accompanying a Third Party Service and seek clarifications as needed before deciding to install and/or use their services.

  • Where do we Store/Process your ‘Personal Information’? Reekolect processes data about individuals worldwide and may transfer Personal Information outside of your country. We prioritize your security, privacy, and confidentiality. Therefore, Reekolect conducts a vetting process, including an assessment of privacy laws in the countries to which we transfer data, to ensure they have robust data protection laws.

5.1. User's personal information is controlled by Reekolect in Israel, which the European Commission considers a country offering an adequate level of protection for the Personal Information of E.U. Member State residents.

5.2. If you are in Europe, the U.K., or Switzerland, when we transfer your Personal Information to a location outside of Europe, we ensure that either the European Commission deems there is an adequate level of protection or that relevant Standard Contractual Clauses are in place. These clauses align with Regulation (E.U.) 2016/679 of the European Parliament and of the Council from June 4, 2021, as well as the ICO’s International Data Transfer Addendum to the E.U. Commission Standard Contractual Clauses version B1.0, effective from March 21, 2022.

5.3. Reekolect takes additional measures to comply with European data protection laws when transferring E.U. Personal Information to a third country not found to adequately protect such information by the European Commission.

5.4. Privacy Shield Certification: Reekolect and its affiliates, including DeviantArt Inc., participate in and certify compliance with the E.U.-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. For more information about the Privacy Shield Framework, visit the U.S. Department of Commerce’s Privacy Shield List.

Regarding Personal Information received or transferred under the Privacy Shield Framework, Wix.com is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission (FTC). In accordance with the Privacy Shield Principles, Reekolect is committed to resolving complaints about our collection or use of your Personal Information. E.U. and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact us at: [Insert Privacy Shield Contact Email].

Reekolect has also committed to refer unresolved Privacy Shield complaints to an alternative dispute resolution provider in the United States. If you don't receive timely acknowledgment of your complaint from us, or if we haven't addressed your complaint to your satisfaction, you may invoke binding arbitration under certain conditions described on the Privacy Shield website.

For clarity, Reekolect doesn't rely on the Privacy Shield as a mechanism for transferring GDPR-protected personal data. Currently, Reekolect relies on other transfer mechanisms, as detailed above, such as the Standard Contractual Clauses or an adequacy decision.

 

  • 6. Users-of-Users’ ‘Personal Information’ At Reekolect, we may collect, store, and process specific Personal Information of Users-of-Users ("Users-of-Users Information") solely on behalf of our Users and in accordance with their instructions. For instance, our Users can import their email contacts from third-party services like Gmail or manage contacts through their User Website, and such contact data is stored with Reekolect on behalf of the User.

In this context, Reekolect acts as a "Processor" and not as the "Controller" (as defined in the European Union General Data Protection Regulation or "GDPR") of Users-of-Users Information. The Users who control and operate these User Websites are considered the "Controllers" of Users-of-Users Information. They bear responsibility for complying with all applicable laws and regulations governing the collection and control of such Users-of-Users Information, including privacy and data protection laws in relevant jurisdictions.

Processing of Users-of-Users' Personal Information occurs within the European Union, Israel, or another third country, territory, or specified sector within a third country for which the European Commission has determined an adequate level of protection. Such processing and transfer adhere to the Data Processing Addendum – Users ("DPA"). Any transfer and processing in a third country outside the European Union not ensuring an adequate level of protection, as determined by the European Commission, will be conducted under an approved transfer mechanism detailed in the DPA.

You bear responsibility for the security, integrity, and lawful usage of Personal Information concerning Users-of-Users. You are also responsible for obtaining consents, permissions, and providing any necessary data subject rights and fair processing notices for the collection and usage of such Personal Information.

While Reekolect cannot provide legal advice to Users or their Users-of-Users, we strongly recommend that all Users publish and maintain clear and comprehensive privacy policies on their User Websites in compliance with applicable laws and regulations. Users-of-Users should carefully read these policies and ensure they understand and, where required by applicable law, consent to them.

For more details on how Users-of-Users Personal Information may be handled by Reekolect (which may be pertinent to any specific notice you provide to and/or consent you obtain from your Users-of-Users), please refer to Sections 4, 12, and 13.

If you are a visitor, user, or customer of any of our Users, please note the following: Reekolect does not have a direct relationship with Users-of-Users whose Personal Information it processes. If you are a visitor, user, or customer of any of our Users and have requests or inquiries concerning your Personal Information, please contact the relevant User(s) directly. For example, if you wish to request access, correction, amendment, or deletion of inaccurate Personal Information processed by Reekolect on behalf of its Users, kindly direct your query to the relevant User, who serves as the "Controller" of such data. If Reekolect is instructed by our Users to remove any Users-of-Users’ Personal Information, we will respond to such requests promptly upon verification and in compliance with applicable law (e.g., within thirty (30) days under the GDPR). Unless otherwise instructed by our User, we will retain Users-of-Users’ Personal Information for the duration specified in Section 12 below.

  • 7. Use of cookies and other third-party technologies Reekolect and our Third Party Service Providers utilize cookies and similar technologies ("Cookies") to provide and optimize our Service, analyze performance and marketing activities, and personalize your experience.

Please note that we do not alter our practices in response to a "Do Not Track" signal in the HTTP header from a browser or mobile application. However, most browsers offer controls for managing cookies, including options to accept or reject them and instructions for removing them. You may configure your browser to notify you when you receive a cookie, or you can choose to block cookies altogether.
